General Terms and Conditions for Participation in Promotional Activities

1. Organizing Company

Promotional activities are promoted by New Alternative Technologies SLU, hereinafter referred to as "Newskill," with its registered office at Avenida de Suiza nº 9, Polígono Industrial de Alhama de Murcia (30840) Alhama de Murcia (Murcia) Spain.

2. Scope of Application

Contests and promotions will be extended to the national territory only in the Peninsula and the Balearic Islands.

3. Duration

The start and end dates will be detailed in each of the promotional activities.

4. Participation

To participate in the different promotional activities promoted by Newskill, it is required to be a natural person legally residing in Spain and of legal age. Legal residence, in the case of foreign individuals, will be determined in accordance with current immigration regulations.

The specific conditions for participation will be specified in each promotion.

As a general rule, and unless otherwise stated in a particular promotion, only one entry per person will be allowed.

5. Winners

The winners of the contests will be determined by objective data analysis carried out by Newskill.

Furthermore, the winners of the raffles will be selected by random computer selection systems from among all those who have participated in accordance with the established rules.

Winners will be informed by email or by the publication of their name on Newskill's Social Media or website.

For all contests, a specific number of winners will be designated, depending on the prizes. In addition, a specific number of alternates will also be chosen using the same selection criteria.

If the winner waives the prize, Newskill may decide whether to give it to the alternates or declare it void.

6. Prizes

Each of the prizes awarded will be described in the different promotional activities. In the case of an in-kind prize, it cannot be exchanged for money.

7. Acceptance of Terms and Conditions and Responsibility

Participation in each of the promotional activities carried out by Newskill implies full acceptance of these general terms and conditions and the particular conditions that, where applicable, are established in each promotion.

Newskill reserves the right to cancel the promotion for justified reasons, as well as to modify these terms and conditions or those of the promotional activity at any time or to declare the prize void. If this occurs, participants will be duly informed through the same channel in which the activity was carried out, with a reasoned explanation of the decision.

Likewise, Newskill reserves the right to exclude participants who violate the rules established in the terms and conditions or whose behavior affects the normal development of the promotional activity, as well as to disqualify those who act abusively or fraudulently.

Newskill is exempt from responsibility in the event that it cannot locate the winner for reasons not attributable to the company. The winner also exempts Newskill from responsibility for any damage that may arise from the use of the awarded prize.

Any incident that may arise and is not covered by these terms and conditions will be resolved by Newskill according to its best judgment.

8. Taxation

As established by Law 35/2006 of November 28, which approves the Personal Income Tax, and by Royal Legislative Decree 4/2004, which approves the Consolidated Text of the Corporate Income Tax Law, prizes derived from promotional activities are subject to taxation.

Newskill will be responsible for making the advance payment or applying the relevant withholding. Such withholding or advance payment will not apply to prizes under €300, which are subject to taxation under the Personal Income Tax.

Newskill will not be responsible for the winner's tax obligations.

In order for the aforementioned withholdings to be made, the winner must sign a document justifying receipt of the prize, provide their tax information, and a copy of their identification document (CIF, NIF, or Resident Card). Likewise, they must sign a declaration acknowledging their understanding of the taxation of said prizes.

9. Personal Data

Personal data collected in promotional activities will be governed by the provisions of the Privacy section of our website.

10. Applicable Law and Jurisdiction

Promotional activities, as well as the terms and conditions that regulate them, are subject to Spanish law. Any controversy arising therefrom, and in the absence of an amicable agreement, Spanish courts will have jurisdiction.
