NEW ALTERNATIVE TECHNOLOGIES, S.L.U., the company that owns https://www.newskillgaming.com/, guarantees all computer equipment, components and other products it distributes in accordance with the laws in force and the following conditions
The consumer can contact both the seller and the manufacturer of the product, who will be liable for any lack of conformity within a period of two years from the date of purchase (one year for second-hand products), for products purchased before January 1, 2022. For purchases made after this date, the warranty is extended to 3 years, due to the new consumer regulations.
When the lack of conformity becomes apparent after 6 months and in doubtful cases, the manufacturer may require an independent expert report in order to process the warranty. In obvious cases of malfunction or irregular operation during the warranty period there is no problem.
In any case, during the time the consumer is deprived of the product, the computation of the warranty period is suspended; for example, if the repair of an object takes 15 days, the warranty period will end 15 days later than originally foreseen.
Any manufacturer that has a warranty longer than the 2 years stipulated by the current law, must deal directly with the manufacturer and NEW ALTERNATIVE TECHNOLOGIES, S.L.U. is not responsible for such cases.
NEW ALTERNATIVE TECHNOLOGIES, S.L.U. will be responsible for the shipping costs generated by the processing of the product warranty in those cases where it is assumed that the lack of conformity exists in the purchased good. This should always be done following the instructions indicated by NEW ALTERNATIVE TECHNOLOGIES, S.L.U., upon request and acceptance.
Conditions for companies and distributors: When the customer is a distributor, or invoices as a company (non-physical person), the shipping costs to our facilities will always be charged to the customer, since the law on consumer goods does not regulate the sale and purchase between companies. In addition, the warranty in these cases will be the one stipulated by the manufacturer of the product.
The consumer may complain to the seller when the product does not conform to the contract:
- The purchased good does not conform to the description made by the seller.
- The purchased good is not suitable for the uses for which consumer goods of the same type are normally intended.
- It is not suitable for the special use that would have been required by the consumer and that the seller has accepted.
- It does not present the expected quality and behavior, especially taking into account the public statements (advertising, brochures, labeling ...) on its specific characteristics made by the seller or the manufacturer.
The consumer and user has the right to:
- Repair or replace. The consumer and user will be able to choose between repair or replacement, unless one of the two options is impossible or disproportionate. It will be considered disproportionate which has a higher cost. Non-fungible goods (when they are of a specific nature) and second-hand goods cannot be replaced. Both repair and replacement must be carried out within a reasonable period of time and completely free of charge for the consumer.
NOTE: The warranty can be managed directly with NEW ALTERNATIVE TECHNOLOGIES, S.L.U., however some manufacturers offer direct management of breakdowns/defects/incidents produced in their products to provide a quality after-sales service and reduce the time. In these cases NEW ALTERNATIVE TECHNOLOGIES, S.L.U. will inform you so that you can decide whether to process it with us or with them. - Price reduction or termination of the contract. They will proceed when the consumer and user cannot demand the repair or replacement and in cases where it has not been carried out within a reasonable period of time or without major inconvenience to the consumer and user. The resolution will not proceed when the lack of conformity is of minor importance.
* Warranty processing of promotional products, packs or gifts. If it is a gift, it will be replaced by another equal or, in case it is not possible, of similar value, never for money. If it is a promotional product or pack, if the repair or replacement is not possible, the equivalent amount will be reimbursed, calculated taking into account the real price of the product and the discount obtained by the customer when acquiring it in promotion.
Cancellation of warranties
The warranty may be void for the following reasons:
- Incorrect use, handling or maintenance by the Customer of equipment, multimedia kit, component or peripheral.
- Software problems and/or viruses.
- Components burned by electrical surges or overcurrents.
- Broken or damaged components subjected to impact.
- Improper repair, modification or expansion of equipment by the customer.
- Deterioration, elimination or concealment by the customer of the NEW ALTERNATIVE TECHNOLOGIES, S.L.U. or the manufacturer's warranty label on all products (including those that are part of an equipment, multimedia kit or semi equipment) manufactured or distributed by NEW ALTERNATIVE TECHNOLOGIES, S.L.U.
In short, no damaged material or material with evident signs of incorrect handling will be accepted.
Claims for damages caused by transport
For safety reasons, we recommend that, upon delivery of the order, the packaging is checked for damage. If the order is damaged or broken, the customer may refuse or accept delivery in the following situations:
- In case of accepting the delivery of a damaged package, we advise that, even if the damage is minimal and/or simply in the packaging, the customer should indicate it to the delivery person, leaving a record in the POD or proof of delivery, which will be sent to the transport company, and that we as a company may request in case the product could also present some damage* derived from the transport, and the customer wants a replacement
- In case the delivery is refused, the package is returned to our facilities, enclosing the transport company a proof of damage, and allowing us to send a replacement** to the customer as soon as possible
*The customer has 48h, from the reception of the order, to check the merchandise and to notify an incidence derived from the transport, in case a damaged package was accepted and finally the product was also damaged.
**The replacements derived from transport damages, will be carried out in the same conditions and with the same characteristics as any replacement motivated by the non-fulfillment of the contract.
The warranty does not cover
The warranty does not cover those defects caused by incorrect use of the product and/or handling of the product other than what is necessary to establish its nature, characteristics or operation. In such cases, the consumer shall be responsible for its repair. They are, therefore, excluded from the warranty
- Defects and deterioration produced by external events, accidents, mainly electrical accidents, by wear and tear and by use not in accordance with the instructions of NEW ALTERNATIVE TECHNOLOGIES, S.L.U.
- Products modified or repaired by the customer or any other person not authorized by NEW ALTERNATIVE TECHNOLOGIES, S.L.U., as well as products that are the object of a specific support contract.
- Incorrect software/hardware configuration, by the customer, of a device, component or peripheral. Incorrect software/hardware configuration or equipment failure caused by a component not supplied by NEW ALTERNATIVE TECHNOLOGIES, S.L.U. and incorporated by the customer.
- Infection of computer viruses by the customer in equipment, hard disks or driver diskettes or additional software.
To these effects, NEW ALTERNATIVE TECHNOLOGIES, S.L.U. informs that the Revised Text of the General Law for the Defense of Consumers and Users (TRLGDCU) establishes several options to exercise the right of withdrawal. Among them contemplates the possibility of doing so by filling out a form telematically. In order to shorten the time and that you can make the return in a comfortable way and without delays, from NEW ALTERNATIVE TECHNOLOGIES, S.L.U. we advise you to make use of this option and fill out the withdrawal form that will be provided to the formalization of your order, accessing with your username and password
These warranty conditions do not affect the consumer's statutory rights under applicable law.
Optical media (CD-R, CD-RW, DVD-R, DVD+R, DVD-RW, DVD+RW) are not covered by warranty once the packaging or box is opened or unsealed. Only optical media whose packaging has not been opened can be returned at the customer's expense.
NEW ALTERNATIVE TECHNOLOGIES, S.L.U. is not responsible for the personal information contained in the PC or storage unit. The customer is responsible for the data or information in the material to be repaired and for making the pertinent backup copies.
Likewise, the warranty will act with respect to hidden defects and manufacturing defects of the product in accordance with article 1490 of the CC.
